Usage Rights for your Image & Video: General Terms of Service
Hello there!
Chances are, you've taken a fantastic photo or video of Cork that we really love, and have clicked the Terms of Service link in our message request under your photo or video with the hashtag :
#YesPureCork
Hereinafter referred to as 'Hashtag'.
We think our followers will really love your photo or video and we would love to share it with them!
Please Note: We will always ask you for permission to use your photo or video.
What is this note for?
To make sure you are happy for us to use your photo and video content with the appropriate rights on our websites, social channels, and various promotional materials.
What you need to understand
Pure Cork is the official tourism brand for Cork, operated under the overarching brand of Visit Cork.
By responding to our message request with the Hashtag you represent and warrant that:
you are an individual eighteen (18) years of age or older;
you own all rights in and to your photos or videos and they are not copied from any third parties;
you have permission from any adult(s) appearing in your photos or videos to grant the rights herein;
you have permission of parent/legal guardian where minors who have not yet reached the age of 16 may be featured;
you waive (or if waiver is not permissible by law, will not assert) any moral rights or other rights with respect to authorship or integrity of the photos or videos;
you have read and that you agree to the following terms and conditions set out below.
What happens when I respond with one of your hashtags?
By responding to our request message with one of our Hashtags, you grant us permission to use your photo or videos in Pure Cork/Visit Cork content as follows:
You grant Pure Cork/Visit Cork a non-exclusive, unlimited, royalty-free worldwide licence to reproduce, display, perform, distribute, archive, edit, adapt, modify and otherwise use any photo or video content posted or tagged in the comments with the Hashtag.
What this means
This means by responding with one of the Hashtags to our request message, you assign Pure Cork/Visit Cork the right to use the photos or videos in our marketing and/or advertising.
For example, your photos or videos could be used:
on our social media channels,
on our website in a photo gallery,
in email newsletters,
in printed materials,
at tourist information centres or event activations,
in internal communications,
or in advertising, including outdoor posters, online video, or television.
Credits: Where possible, we will credit your social handle for your content.
We may exercise our rights anywhere in the world, and the consent granted will apply for:
Adults = 7 years or until the individual withdraws their consent (whichever occurs first).
Children (under the age of 16) = 5 years or until the individual withdraws their consent (whichever occurs first).
You waive the right to inspect or approve the final usage of the image within advertising copy, text or any other promotional material. However, Pure Cork has no obligation to use your photo.
Pure Cork may also use user-generated content (UGC) assets for paid advertising in certain cases where the asset has received high engagement in a previous organic post. The original creator will be credited for each use of their photo or video.
What do I get out of this?
Your photos or videos may be viewed not only by you, but also by other fans of Pure Cork/Visit Cork around the world. You have the opportunity to inspire others with your creativity and show what makes Cork unique.
Pure Cork/Visit Cork may, in its sole discretion, include your social handle or byline when using your photos.
Our licence is non-exclusive, meaning you can still use your photos and videos for your own purposes and let others use them too.
In return, you release and discharge Pure Cork from all and any obligation to pay you in connection with our use of your photos as described above, including any intellectual property rights contained therein, when you respond with one of our Hashtags.
Privacy
We respect your privacy and we value the trust you have put in us.
In reaching out to you about your photos, we necessarily process your social media username. We only use this personal information for the purposes described above.
We are committed to keeping your personal information safe. We have physical, technical and administrative measures in place to prevent unauthorised access or misuse of your information.
Can I change my mind?
If you change your mind you can simply revoke the granting of these rights to Pure Cork by sending us an email at info@visitcork.ie or by requesting the removal of an image used on our social media accounts by direct message on our social channels.
We aim to respond to all requests within one month in order to outline the next steps.
You can ask Pure Cork to stop using your images at any time, in which case it will not be used in future publications.
Note: This will not apply to material already published. Pure Cork cannot control or recall previously published material.
